Application Terms of Use

Privacy Policy

This agreement is written in masculine form for convenience only, but is intended for both women and men. Please read this agreement carefully before installing the Forty application (hereinafter referred to as "Forty") (hereinafter referred to as the "Application").

• Any use of the Application, including any updated version, modification, improvement, update and/or upgrade of the Application provided by Forty is subject to, and will be subject to, the terms and conditions detailed in this agreement. By using the Application and/or by installing the Application on your mobile phone, you agree to this agreement and confirm that you have read and understood Forty's Terms of Use at https://www.forty.co.il/terms-of-use/en (hereinafter referred to as the "Terms of Use") and that you agree that the terms and conditions of this agreement, the Terms of Use and Privacy Policy will be binding upon you.
• If you do not agree to this agreement and to the terms and conditions of Forty's Privacy Policy and Terms of Use, or if you do not want these terms and conditions to bind you, please do not install the Application, and immediately delete the Application, and any part thereof, from your mobile phone and do not use it for any purpose and in any manner.
• Ownership and Property Rights - The Application and documents accompanying the Application are the exclusive property of Forty and will remain its exclusive property. All intellectual property rights (including, among others, copyrights, trade secrets, trademarks, patents and the like) existing and/or embodied in the Application, and/or attached, connected, and/or relating to the Application are the exclusive property of Forty and will remain its exclusive property as stated. Nothing in this agreement transfers to you any right in the Application or in connection therewith, except for a limited right to use it in accordance with the terms of this agreement. Nothing stated in this agreement constitutes a waiver of Forty's intellectual property rights under any law.
• License - Forty hereby grants you, and you accept, a limited, personal, non-exclusive, non-transferable, non-commercial license, under which sub-licenses cannot be granted, and which is fully revocable, to use the Application on a mobile phone owned or controlled by you, all in accordance with the terms and conditions included in this agreement. Forty reserves for itself all rights in the Application that were not expressly granted under this license agreement.
• Prohibited Uses - Except as expressly permitted in this agreement, without prior written consent from Forty, you agree not to: (i) use, modify or integrate the Application into other software, or create derivative works from any part of the Application; and - (ii) sell, license (or sub-license), lease, assign, transfer, mortgage or share your rights under this agreement with any other person; (iii) copy, distribute or copy the Application for the benefit of third parties; (iv) disclose the performance results of the Application, or use such results for development or development activities of competing software owned by you; and/or (v) modify, disassemble, perform reverse compilation, reverse engineering, update or improve the Application or attempt to discover the source code of the Application.
• Maintenance and Support. Forty has no obligation under this agreement to provide support, maintenance, upgrades, changes or new versions of the Application. However, Forty may from time to time release upgrade versions of the Application and may electronically and automatically upgrade the version of the Application you use on your mobile phone. You give your consent to such automatic upgrade, and agree that the terms of this agreement will apply to all such upgrades.
• Disclaimer - The Application is provided to you "as is" without any warranty of any kind, express or implied. Forty does not guarantee that the Application will meet your requirements or that the operation of the Application will be performed without interruption or without errors. To the extent permitted by law, Forty hereby expressly excludes all express warranties, including among others, warranty of title or non-infringement of proprietary rights, and from any warranty whatsoever, including among others, any warranty of merchantability and fitness for a particular purpose. Forty is not responsible and does not guarantee the accuracy, completeness, uses or reliability of the results that will be obtained through use of the Application or of any data or information that will be obtained otherwise through use of the Application. You acknowledge that all information or data that you download or obtain or acquire otherwise through use of the Application will be at your sole risk and at your sole discretion and that Forty will not be responsible and will not bear any responsibility for any damage that will be caused to you or your property. It is further clarified that the maps, map data and other related content available through your use of the Application are owned by Forty or licensed to it and are provided to you "as is" and without any warranty of any kind.
• Termination of Engagement - Forty is entitled to terminate the license granted under this agreement at any time and for any reason. Without prejudice to the foregoing, your breach of the terms of this agreement will bring the license granted to you and this agreement to termination. Upon termination of this agreement by Forty: (i) the license granted to you in this agreement will expire, and you, upon termination of the agreement, will cease any further use of the Application; and - (ii) you will return to Forty all tangible property that includes Forty's intellectual property rights and all copies thereof and/or delete or destroy all information in connection therewith that is held by you electronically. Sections 3, and 7 through 12 of this agreement will remain in effect even after termination of this agreement.
• Governing Law; Jurisdiction - This agreement and its interpretation will be governed solely by the laws of the State of Israel (without giving effect to the international choice of law rules set forth therein). The competent courts in the Tel Aviv district will have exclusive jurisdiction in any dispute or disagreement that arises between the parties as a result of this agreement. It is expressly agreed by the parties that the provisions of the United Nations Convention on Contracts for the International Sale of Goods are expressly excluded from the scope of this agreement.
• Third Party Software - If the Application includes any software provided by third parties, then such third party software is provided "as is" without any warranty of any kind, and such software will be subject to all limitations and conditions required by such third party.

Information We Retain

All information stored with us in the system is secure. We retain the following information to enable you to enjoy the capabilities of our application and so you can use it on different phone devices.

• Registration details - for identification purposes.
• Location (with consent only) - for the feature of finding friends in your area.

Additionally, we retain information for user behavior analysis purposes. This information is not linked to the user.

Information Deletion

Every user can delete all information about them by deleting their profile. Profile deletion is done through the application, on the user's profile page. On this page there is an option to delete the profile and all information associated with it.

Joining the Database

1. Providing details as part of registration to "Forty" is done of my own free will and without legal obligation to do so.
2. By registering and checking the consent box on the "Forty" registration page, I confirm my consent to the terms of this regulation.
3. By registering for "Forty" and the application services, the user gives his explicit consent to register his details in the databases of Forty Technologies Ltd. and the companies listed in section 5, and that the companies will send him from time to time by email and/or by SMS and/or by WhatsApp and/or by any other means including through telephone contact, and/or in any other way permitted by law, information about their services, including marketing and advertising information, as well as marketing and advertising information of other advertisers and the user also confirms receipt of advertising content, information and direct marketing approaches.
4. I know that at any time I can cancel my consent to receive advertising mailings or marketing approaches from Forty Technologies Ltd. and the companies listed in section 5.

7. For the avoidance of doubt, it is clarified hereby, and I agree that "Forty" and the companies listed in section 5 will be entitled to use my details as detailed in this regulation even after the end of use in the application and until my explicit request to them to cancel my consent to receive advertising mailings or marketing approaches.
8. I know that "Forty" is not a party to any engagement of mine with one of the companies in section 5. "Forty" is not responsible for the quality of products or services that will be offered to me by any of these companies.
