Privacy Policy
This agreement is written in the masculine language for convenience only, but is intended for both women and men. Please read this agreement carefully before installing Forty application (hereinafter – "Forty") (hereinafter – the "Application").
- Any use of the application, including any updated version, change, improvement, update and/or upgrade of the application that will be provided by Forty is, and will be, subject to the terms and instructions detailed in this agreement. By actually using the application and/or by installing the application on your mobile phone, you agree to this agreement and you confirm that you have read and understood Forty's usage agreement at https://www.forty.co.il/terms-of-use (hereinafter – the "Use Agreement") and that you agree that the terms and provisions of this Agreement, the Terms of Use and the Privacy Policy will bind you.
- If you do not agree to this Agreement and the terms and instructions of Forty's Privacy Policy and the Terms of Use, or if you do not wish to be bound by these terms and instructions, please do not install the Application, and immediately delete the Application, and any part of it, from your mobile phone and do not use it for any purpose and in any Manner.
- Ownership and ownership – the application and the documents accompanying the application are the sole property of
- Forty and will remain its sole property. All intellectual property rights (including, among other things, copyrights, trade secrets, trademarks, patents, and the like) existing and/or embodied in the application, and/or attached, related, and/or referring to the application are and will remain the sole property of
- Forty as mentioned. This agreement does not convey to you any right in or in connection with the application, but only a limited right to use it in accordance with the terms of this agreement. Nothing in this agreement constitutes a waiver of Forty's intellectual property rights under any law.
- License – Forty hereby grants you, and you accept, a limited, personal, non-exclusive, non-exclusive, non-commercial, non-sublicensable, and fully revocable license to use the application on a mobile phone owned or controlled by you, any This is in accordance with the terms and instructions included in this agreement. - Prohibited Uses – Except as expressly permitted in this Agreement, without Forty's prior written consent, you agree not to: (i) use, modify or integrate the Application into other software, or create derivative works of any part of the Application; and – (ii) sell, license (or sublicense), lease, assign, transfer, pledge or share your rights under this Agreement to any other person; (iii) copy, distribute or reproduce the application for the benefit of third parties; (iv) disclose (disclose) the results of the application's performance, or use these results for the development or development activities of competing software that you own; and/or (v) modify, disassemble, decompile, reverse engineer, update or improve the Application or attempt to discover the source code of the Application.
- Maintenance and support. Forty has no obligation under this Agreement to provide support, maintenance, upgrades, changes or new versions of the Application. However, Forty may from time to time release upgrade versions of the Application and may electronically and automatically upgrade the version of the Application that you are using on your mobile phone. You consent to such automatic upgrade, and agree that the terms of this Agreement will apply to all such upgrades.
- Disclaimer – The application is provided to you "as is" without any warranty of any kind, express or implied. Forty does not guarantee that the application will meet your requirements or that the operation of the application will be uninterrupted or error-free. As far as this is permitted by law,
- Forty hereby expressly excludes any express warranty, including, among others, a warranty of the right of ownership or non-infringement of a property right, and any warranty of any kind, including, among others, any warranty of commercial quality and suitability for a particular purpose.
- Forty is not responsible and does not guarantee the accuracy, completeness, uses or reliability of the results that will be obtained through the use of the application or of any data or information that will be obtained in any other way through the use of the application. You confirm that all information or data that you download or obtain or acquire in any other way through the use of the application will be at your sole risk and at your discretion only and that Forty will not be responsible and will not bear any responsibility for any damage that may be caused to you or your property. It is further clarified that the maps, map data and other related content available through your use of the application are owned by or licensed to Forty and are provided to you "as is" and without any warranty of any kind.
- Termination of the contract – Forty may terminate the license granted under this agreement at any time and for any reason. Without prejudice to the foregoing, your breach of the terms of this Agreement will terminate the license granted to you and this Agreement. Upon termination of this agreement by Forty: (i) the license granted to you in this agreement will expire, and you, upon termination of the agreement, will cease any further use of the application; and – (ii) you will return to Forty any tangible property that includes Forty's intellectual property rights and all copies thereof and/or delete or destroy any information in connection therewith held by you electronically. Sections 3, and 7 to 12 of this agreement will remain in effect even after the termination of this agreement.
- Jurisdiction – this agreement and its interpretation shall be exclusively governed by the laws of the State of Israel (without giving effect to the international choice of law rules set forth therein). The competent courts in the Tel Aviv district will have exclusive jurisdiction over any conflict or dispute that may arise between the parties as a result of this agreement. The parties expressly agree that the provisions of the United Nations Convention on Contracts for the International Sale of Goods are expressly excluded from the scope of this agreement.
- Third-party software – if the application includes any software provided by third parties, then this third-party software is provided "as is" without any warranty of any kind, and said software will be subject to all restrictions and conditions required by said third party.
Data Deletion
Any user can delete all information about themselves by deleting the profile.
The profile is deleted through the application, on the user's profile page. On this page there is the option to delete the profile and all the information related to it.
